Terms of Service
In effect from 18 September 2026.
These terms are the agreement between you and Waypoint Systems LLC for using NowWhat. Using NowWhat means you accept them.
1. Who may use NowWhat
You must be 18 or older and able to enter a contract. NowWhat is for your own use as a family caregiver, or for the person you are caring for, and not for resale or for running a business service on top of it.
You are responsible for the device you use and, if you add an email address, for the mailbox that receives your sign-in links. Anyone who can open that mailbox can open your account.
2. What NowWhat is, and what it is not
NowWhat is a guide to the process of caring for someone through a health crisis. It explains what usually happens at each stage, what to ask, what to gather, and what can wait.
NowWhat is not a medical provider, a law firm, an insurance company, or a financial adviser. Nothing in it is medical, legal, financial, or insurance advice. Using it does not create a doctor and patient relationship or a lawyer and client relationship.
NowWhat cannot see your loved one's medical records, does not know their diagnosis unless you type it, and cannot make decisions for you. For medical decisions, ask the care team. For legal decisions, ask a lawyer licensed in your state. In an emergency, call 911.
3. Morgan, and answers written by AI
Morgan's answers are generated by an AI model from Anthropic. They are not written or checked by a person before you see them.
AI can be wrong. An answer can be out of date, incomplete, or confidently mistaken, and rules about benefits and coverage change often and differ by state and county. Morgan shows where an answer came from when it can. Check anything you are going to act on with the care team, the agency, or a professional before you rely on it.
Morgan answers questions about the process. It will not diagnose, will not recommend treatments or doses, and will not tell you what to decide.
NowWhat includes three free questions before a trial, and a fair use ceiling of 150 questions a month on a paid plan. That ceiling exists to keep the service running for everyone and may change if it stops doing that job.
4. The trial, the plans, and how billing works
NowWhat offers a free trial of 7 days. After the trial, a subscription is $9.99 per month or $79 per year.
On an iPhone, your subscription is sold and billed by Apple through your Apple Account. We never see your card. Apple charges you when the trial ends and at the start of each period after that.
A subscription renews automatically until you cancel. Cancel at least 24 hours before the current period ends, or Apple will charge for the next one.
To cancel, open the Settings app on your iPhone, tap your name, then Subscriptions, and cancel NowWhat there. Deleting the app does not cancel a subscription and does not stop billing.
If we change what a plan costs, we will tell you before the change applies to you, and you can cancel before it does.
5. Refunds
Purchases made through the App Store are handled by Apple, and refunds are Apple's to give. Ask for one at reportaproblem.apple.com. We cannot refund an Apple purchase ourselves, however much we might want to.
If you believe you were charged in error, write to support@getnowwhat.app and we will help you take it to Apple.
Nothing here removes rights you have under the law where you live.
6. What you write stays yours
Your notes, your checklist, and everything else you put into NowWhat belong to you. We do not claim ownership of any of it.
You give us permission to store and process what you write only so far as running NowWhat requires: saving it, syncing it between your devices, and sending the parts Morgan needs to answer your question. We do not use it to train an AI model and we do not sell it. The Privacy Policy sets out who handles it.
You can delete it at any time with Delete All My Data, or remove the account entirely with Delete my account.
7. Acceptable use
Use NowWhat for caring for someone. Do not use it for anything unlawful.
- Do not try to break, probe, or overload the service, or reach data that is not yours.
- Do not use bots, scrapers, or automated tools against it, or resell it, or build a competing service out of its answers.
- Do not upload another person's information that you have no right to share.
- Do not use NowWhat as a substitute for a professional where a professional is needed, including for any decision about treatment.
- Do not misrepresent NowWhat's answers as medical, legal, or financial advice from us.
8. The service itself
We may change, add, or remove features, and we may take the service down for maintenance. We aim to keep it available and cannot promise it will never be interrupted.
Links and resources NowWhat shows you, including government sites and local services, are not ours. We do not control them and do not endorse them by listing them.
9. Disclaimers
NowWhat is provided as it is and as it is available. To the fullest extent the law allows, we make no warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the information in NowWhat, including anything Morgan writes, is accurate, complete, or current, or that the service will be uninterrupted or error free.
Some places do not allow these exclusions, and where that is so, they do not apply to you.
10. Limitation of liability
To the fullest extent the law allows, Waypoint Systems LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or the cost of substitute services, arising from your use of NowWhat.
To the fullest extent the law allows, our total liability for any claim relating to NowWhat is limited to the greater of the amount you paid us in the 12 months before the claim, or 100 US dollars.
Nothing here limits liability that cannot be limited by law, including liability for fraud, or for death or personal injury caused by negligence.
11. Indemnity
You agree to cover our reasonable costs, including legal fees, arising from a claim brought by someone else because you used NowWhat in breach of these terms or in breach of the law.
12. Ending it
You can stop using NowWhat at any time, and you can delete your account from Settings. Cancelling a subscription is done through Apple, as described above.
We may suspend or end your access if you break these terms, if we are required to by law, or if we stop offering the service. If we stop offering NowWhat, we will give you notice and a way to take your information with you.
Sections that are meant to survive the end of this agreement do survive it, including what you write staying yours, the disclaimers, the limitation of liability, and the indemnity.
13. Changes to these terms
If these terms change we will post the new version here with a new effective date. If a change matters to what you are agreeing to, we will tell you in the app. Continuing to use NowWhat after a change means you accept the new terms.
14. Governing law and disputes
These terms are governed by the laws of the State of Tennessee, without regard to its conflict of laws rules.
If something goes wrong, write to support@getnowwhat.app first and give us 30 days to put it right. Most things can be settled that way.
If they cannot, you and Waypoint Systems LLC agree that any dispute will be brought in the state or federal courts located in Shelby County, Tennessee, and both of us consent to those courts.
15. If you downloaded NowWhat from the App Store
These terms are between you and Waypoint Systems LLC. Apple is not a party to them.
Apple has no obligation to provide maintenance or support for NowWhat. If NowWhat fails to conform to any warranty that applies, you may tell Apple, and Apple may refund what you paid for it. To the fullest extent the law allows, Apple has no other warranty obligation for NowWhat.
Apple is not responsible for addressing any claim you or anyone else has about NowWhat, including product liability claims, claims that NowWhat does not meet a legal requirement, and claims under consumer protection or similar law.
Apple and its subsidiaries are third-party beneficiaries of these terms, and Apple may enforce them against you.
16. The rest
These terms, together with the Privacy Policy, are the whole agreement between you and us about NowWhat. If any part of them is found unenforceable, the rest stays in force.
